A note on unauthorised transactions

The most significant change in this notice is the introduction of a new, comprehensive unauthorised transactions clause in the Retail Banking Terms and Conditions (clause 15), aligned with the ePayments Code. It replaces the shorter, channel-specific provisions that previously sat in the Card clause of the Retail Banking Terms and Conditions and in clause 10.5 of the Access Terms and Conditions. Overall, this change strengthens the protections available to you.

Changes to our Retail Banking Terms and Conditions

These changes apply to the Retail Banking products and services you hold with us. The changes are grouped below by the part of the document they affect.

Accounts, features and access

Summary of the change

How this change is reflected in our terms and conditions

Number of accounts

We may limit the number of accounts of a particular type that you can hold at any one time. Any limit that applies is set out in the target market determination for that account on our website and will be advised to you when you apply.

Some members currently hold more accounts of a type than the applicable limit allows, and we may close the additional accounts in those circumstances.

We will not close any additional accounts under this clause before 1 November 2026.
A new clause 6.12 “Number of accounts” has been inserted into clause 6 “Product features” of the Retail Banking Terms and Conditions.

Any closure of additional accounts under that clause will be made in accordance with clause 20 “Termination”.

As a transitional measure, we will not exercise the power to close additional accounts under clause 6.12 before 1 November 2026.

Cash out at participating merchants

Cash out at a participating merchant is a way to access the funds in your account using your Card. It does not replace or restrict any way you can already access your funds.

A participating merchant may impose its own restrictions, including a limit on the amount of cash out available and a requirement that you also make a purchase.
Clause 6.3 “Withdrawals” has been amended to expressly add “cash out at a participating merchant” as a withdrawal type, and to note that additional restrictions may be imposed by the ATM provider or merchant, including a limit on the amount of cash out available and a requirement that you also make a purchase.

Clause 13.2 “Using the Card” has been amended to explicitly confirm the Card can also be used to obtain cash out at participating merchants.

Notice period for suspension or cancellation

We have removed the statement that we would usually give a minimum of four days’ notice before cancelling your accounts and access and instead aligned the notice period with our termination clause, under which we will usually give you at least 14 days’ notice.
Clause 3 “Suspension” has been amended to remove the words “(usually a minimum of 4 days)” and to instead provide that reasonable notice will be given in accordance with clause 20(d) of the Retail Banking Terms and Conditions, under which we will usually give you at least 14 days’ notice.

Term deposits

The following changes apply if you hold a term deposit with us.

Summary of the change

How this change is reflected in our terms and conditions

Term deposit maturity (reinvestment on your instructions)

We have set out more clearly what happens to your term deposit when it matures.

Before maturity you may instruct us to reinvest your funds into a new term deposit. Each rollover will be a new term deposit, with a new term and the interest rate that applies at the time it is opened.

If you do not give us rollover instructions, your deposit and any interest earned during the term will be paid into your nominated transaction account as it is today.
Clause 7.2 “Release of funds” has been amended to describe the term deposit rollover process and to confirm that each rollover is a new term deposit with a new term at the interest rate applying when it is opened.

Early release of term deposit funds

We have clarified that our discretion to allow you early access to funds held in a term deposit will be exercised reasonably.
Clause 7.2 “Release of funds” has been amended so that a decision to allow you access to the funds will be at our sole discretion, acting reasonably.

Cards, Click to Pay and direct debits

Summary of the change

How this change is reflected in our terms and conditions

Click to Pay (new feature)

Click to Pay is a service provided by the Card Scheme that allows you to complete online purchases with participating merchants without entering all your Card details. Click to Pay replaces your Card details with a secure digital token, so your full Card details are not shared with merchants. Some Cards may not be eligible.

Your Card must be registered with the Card Scheme before you can use Click to Pay. You can register your Card, update your details and deregister at any time through the CTP Portal. If we issue you a replacement Card, you will need to register that replacement Card in the CTP Portal to continue using Click to Pay.

Purchases made using Click to Pay are transactions under the Retail Banking Terms and Conditions.
A new clause 14 “Click to Pay” has been inserted into the Retail Banking Terms and Conditions, comprising clause 14.1 “General” and clause 14.2 “Registration”.

Clause 14.1 confirms that clauses 13.8 “Chargebacks” and 15 “Unauthorised transactions” apply to Click to Pay purchases.

New definitions of “Click to Pay” and “CTP Portal” have been added to the definitions clause.

Chargebacks separated from unauthorised transactions

The terms dealing with chargebacks and the terms dealing with liability for unauthorised transactions have been separated, so that liability for unauthorised transactions is dealt with in one place across all payment channels.
Clause 13.8 of the Retail Banking Terms and Conditions has been retitled from “Liability for unauthorised transactions on your Card” to “Chargebacks”.

The provisions in clause 13.8 dealing with liability for unauthorised transactions on a Card have been removed and replaced with a cross-reference to new clause 15 “Unauthorised transactions”.

Direct debit via Cards

A reference to “Debit Card” has been updated to refer to your “Card”, which is consistent with the defined term used throughout the document.
Clause 12 “Direct Debits” has been amended so that it refers to payments processed using your Card being dealt with under clause 13.

Unauthorised transactions

Summary of the change

How this change is reflected in our terms and conditions

Consolidated unauthorised transactions clause

We have introduced a single, comprehensive clause dealing with unauthorised transactions. Unauthorised transactions are transactions on your account that you did not authorise. It applies to unauthorised electronic transactions however they are initiated, including through the app, the online portal, a Card, a PayID or a Payment Agreement, except where the BPAY liability terms apply.

The clause explains: how to report a lost, stolen or misused Card or pass code, or an unauthorised transaction, at any time 24 hours a day, 7 days a week; when you are not liable (and that we will reimburse the amount of the transaction and refund any fees, charges or interest you incurred as a result); when you may be liable; and the limits on your liability.

It confirms that nothing in the Terms and Conditions makes you liable for an unauthorised transaction to any greater extent than the ePayments Code permits, and that the Code prevails over any inconsistency.
A new clause 15 “Unauthorised transactions” has been inserted into the Retail Banking Terms and Conditions, comprising:
  • 15.1 “General” — what an unauthorised transaction is, the channels the clause applies to, and the meaning of “pass code” and “pass code security requirements” (clauses 5.1 and 13.6);
  • 15.2 “Reporting” — the obligation to tell us as soon as possible, and the reporting channels, including 1300 362 216 (or 1800 621 199 outside business hours);
  • 15.3 “When you are not liable” — seven circumstances in which you are not liable, and our obligation to reimburse and refund;
  • 15.4 “When you may be liable” — limited to fraud, non-compliance with the pass code security requirements, or unreasonable delay in telling us; and
  • 15.5 “Limits on your liability” — including the $150 cap where it is not clear whether you contributed to the loss, and the ePayments Code precedence provision.
Clause 9.4 “Liability for BPAY payments” continues to apply to BPAY payments.

Complaints, disclosures and administrative changes

Summary of the change

How this change is reflected in our terms and conditions

Complaints response timeframe

We have expressly incorporated complaint response timelines into the terms and conditions, confirming that complaints will be resolved within 30 days or an update provided where that is not possible.
Clause 33 “Complaints” has been amended to include our commitment to resolving complaints within 30 calendar days.

Changes to our Access Terms and Conditions

These changes apply to your use of the MoveBank app and online portal.

Summary of the change

How this change is reflected in our terms and conditions

Unauthorised transactions and mistaken payments moved

The sub-clause dealing with unauthorised transactions and mistaken payments has been removed from the Access Terms and Conditions. These matters are now dealt with in one place, in the Retail Banking Terms and Conditions, so that a single set of terms applies across all channels. Your obligation to tell us promptly about a mistaken payment or an unauthorised transaction, and to assist us with our investigation, is unchanged.
Clause 10.5 “Unauthorised transactions and mistaken payments” has been removed in its entirety from clause 10 “Electronic funds transfers” of the Access Terms and Conditions. The sub-clauses that followed it have been renumbered accordingly.
These matters are now dealt with under clause 15 “Unauthorised transactions” of the Retail Banking Terms and Conditions.

Liability for unauthorised BPAY payments

We have removed ambiguity relating to liability for unauthorised BPAY payments. This change benefits members.

Under clause 11.4 “Liability for BPAY payments”, in the “Unauthorised payments” sub-heading, the clause providing that you would be liable for the payment if we were unable to recover the amount within 20 Business Days has been removed from the Access Terms and Conditions.
